Job Summary: The Head of Legal at Marian Financial will oversee all legal aspects of the company, ensuring compliance with real estate regulations across various states, managing legal risks, and providing strategic legal advice. This role requires a deep understanding of the real estate market, expertise in loan origination, and strong capabilities in authoring legal documents tailored to Marian's innovative solutions; namely ‘subject to’ purchases and seller finance. This role is for a lawyer that would like to join the core team as a critical member of our fast growing startup. This is not for the company's external legal representation, but rather a key internal team member with a legal background.

Key Responsibilities:

• Develop and implement legal strategies to support Marian Financial’s business objectives.

• Ensure compliance with real estate laws and regulations in different states.

• Oversee the legal aspects of loan origination and management processes.

• Draft, review, and negotiate contracts, agreements, and other legal documents.

• Provide legal advice and support to the executive team on a wide range of issues, including regulatory compliance, risk management, and corporate governance.

• Manage and mitigate legal risks by designing and implementing company policies and procedures.

• Supervise external legal counsel and manage relationships with external legal firms.

• Stay abreast of industry trends, legal developments, and emerging risks to ensure the company remains compliant and competitive.

• Lead the legal team, providing mentorship and guidance to ensure high performance and professional development.

• Collaborate with other departments, including operations, technology, and finance, to ensure legal considerations are integrated into business strategies.

Qualifications:

• Juris Doctor (JD) degree from an accredited law school.

• Licensed to practice law in the state of [Insert State] and in good standing with the state bar association.

• Proven experience as a senior legal executive, preferably in the real estate or financial services industry.

• Extensive knowledge of real estate laws and regulations in multiple states.

• Familiarity with ‘subject to’ purchases and seller finance.

• Strong background in loan origination and management.

• Excellent leadership and management skills, with the ability to inspire and motivate a legal team.

• Exceptional analytical, negotiation, and problem-solving abilities.

• Outstanding communication and interpersonal skills.

• Thorough understanding of regulatory compliance, risk management, and corporate governance.

Preferred Skills:

• Experience with community-focused financial models and practices.

• Familiarity with technology and software development related to real estate and financial services.

• Ability to manage multiple projects and prioritize effectively in a fast-paced environment.

• Bilingual abilities are a plus.

Working Conditions:

• This position may require occasional travel to meet with clients, partners, and attend industry events.

• Must be able to work flexible hours to accommodate the needs of the business.

About Marian Financial:

Marian empowers landlords and homeowners to build passive income. Marian is enabling sellers to sell homes “subject-to” their original loans. Marian automates 80% of the tasks involved in this real estate investing documentation process and provides both sellers and buyers a white glove experience throughout. By October 2024, 100s of homeowners will have used Marian to pocket more whilst buyers will have benefited from significantly lower interest rates. Marian is more accessible and efficient, less capital-intensive and time-consuming.
